A pre-ticked box is not consent here.
Section 6 wants a clear affirmative action.
Affirmative means you did something.
A box already ticked is their action, not yours.
Pause. Does scrolling count as agreeing?
Scrolling is not an action of agreement.
Nor is continuing to use the app.
The Act asks for a clear signal from you.
Silence was never consent.
If you did nothing, you agreed to nothing.
